Narok County govt sued for alleged demolition of resident’s premises at night

A businessman has gone to court to stop the county government of Narok from interfering with his properties in Narok town.

The businessman Rimoine ole Sordo sued the County Government of Narok for allegedly demolishing his premises at the night of 4th January 2018 to build a permanent road without his knowledge. He said he acquired the land “reference number Plot 55 Block 2” 40 years ago and has been paying land rates to county.

The county Government of Narok, the Governor and county executive member lands county were listed as respondents in the case filled by advocate of High Court Lucas Naikuni of law firm Naikuni,Ngaah and Miencha Company Advocates.

In an affidavit Rimoine said the county government again took machines to the site on April 2019 ignoring court orders issued on January 2018 for status quo to be maintained.

“The acts of omission and commission by the defendants tantamount to contempt of court and may have very serious consequences bording on criminality,” Part of the Petitioner’s request to court read. The petitioner has also sought the plot to be fenced off in order to maintain peace and tranquility until the matter is heard and finalized.

In response the County Government of Narok through Narok town administrator Godfrey Ndubi maintained that the land “reference number Plot 55 Block” does not exist, the petitioner is not a registered as a proprietor of any such land. The petitioner had purported to unlawfully erect structures on a public road.

He said the national government under Kenya Rural Road Authority (KURA) is in the process of upgrading roads in the town and its environs to facilitate easy access of members of public on Madaraka Day celebrations to be held in the county on 1st June 2019.
