Court throws out Kajiado MCA nomination appeal case

The Court of Appeal has today thrown out appeal of Kajiado County nominated Member of County Assembly Sandra Mario.

Justice Prof Otieno Odek said the Court has no jurisdiction to hear the appeal of the nominated Member of County assembly.

The High Court in Kajiado had earlier annulled the nomination of the MCA on June this year, the MCA had to appeal.

Justice Reuben Nyakundi had turned down ruling of a lower court and revoked declaration and gazzettement of the ODM politician who is a resident of Kajiado North Sub County.

He ruled that affidavit evidence demonstrated sufficiently existence of reasonable cause that there were procedural and legal deficiencies in the nomination and ordered for fresh nomination for a member to represent special interest and the costs of the appeal be paid by ODM and IEBC.

Magistrates Court that gave Sandra the win on January this year was presided over by Principal Magistrate Margaret Kasera.

The Magistrate had ruled that the petition by Elizabeth Jebet had no merit dismissing the case with all costs incurred by the respondents.

The ODM party will now be forced to nominate a new member to represent special interest groups.
